The appeal of a man serving life in prison for killing his cellmate at the Green Bay Correctional Institution is now in the hands of appeals court judges.
Jackson Vogel is serving a life term with no chance of parole for the Aug. 27, 2024, death of Micah Laureano at the prison. Vogel's appeal asks for the case to be retried.
In a final brief filed Monday, Vogel's attorney argued the trial judge should not have allowed Vogel's comments about cannibalism to be heard by the jury, and that barring a provocation instruction was also an error. The state, in its reply, argued the evidence was admissible.
Attorney Joseph Riephenhoff wrote that the verdict was tainted and that Vogel is asking only for a fair trial where only relevant evidence is presented and the jury is properly instructed.
A ruling is expected to take several months. Separately, Laureano's family has filed a federal civil rights lawsuit against Wisconsin corrections officials over his placement in a cell with Vogel, and no trial date has been scheduled in that case.
