Superior Water, Light and Power has sued the City of Superior over the wording of a ballot proposal scheduled for April of next year.
The City Council approved a question asking voters whether the city should acquire the water utility if it falls within the city's financial means.
In its lawsuit, the utility argues the language could mislead or confuse voters about whether a yes vote would be binding or only advisory. It is asking the court for a permanent injunction that would remove the question from the April ballot in its current form.
Mayor Jim Paine responded that the suit is an attempt to take the decision away from voters, saying the city will see the utility in court.
