Timothy Todd Mahone, 63, of Kenosha was arrested on Aug. 3, 2025, after police said he was driving the wrong way on Washington Road with his taillights not lit. It was his second arrest on suspicion of operating while intoxicated; an earlier OWI conviction was entered in Milwaukee County in 2015.
Body-camera footage from the stop shows Mahone talking repeatedly about his community work, including the foundation that bears his family name, the middle school named for his parents, and a past visit coming from the mayor's office. During field sobriety testing, officers said they smelled intoxicants, and Mahone first described two drinks before acknowledging more alcohol.
Because the earlier conviction was more than 10 years before, officers told him the new case would be treated as a municipal first offense rather than a criminal second offense. The footage also shows Alderman Anthony Kennedy, a friend of Mahone, arriving at the scene and asking about moving Mahone's vehicle; officers declined to release the vehicle or discuss the arrest, and left the car legally parked.
The city filed the OWI citation on Sept. 18, 2025. Mahone pleaded not guilty in writing and requested a jury trial.
On Jan. 27, 2026, the Kenosha City Attorney's Office moved to dismiss the citation, and Judge Angelina Gabriele granted the motion, ending the case without a conviction. Questions have been raised about whether the procedures Wisconsin law requires for dismissing an OWI case — including stating reasons on the record — were followed at the brief hearing.
