No criminal charges will be filed against a Shawano County sheriff's deputy who fatally shot a man during a disturbance call in March, District Attorney Gregory Parker announced Thursday.

The decision concerns the March 10, 2026 death of Jonathan L. Lupe Sr., 38, in the town of Green Valley.

Deputies were called to an apartment in the 2300 block of Highway 22 for a disturbance. When they arrived, they found Lupe locked inside a bathroom.

Investigators said Lupe refused to come out and said he had a gun. Deputies breached the bathroom door and gave verbal commands, and one deputy deployed an electronic control device, which was unsuccessful.

As Lupe moved out of the bathroom toward deputies while holding what officers believed to be a gun, Deputy Cole Vande Hei fired one round from his duty handgun, striking Lupe. Deputies rendered aid and Lupe was taken to a hospital, where he was pronounced dead. No one else was injured.

The state Division of Criminal Investigation later determined Lupe had been holding a .177-caliber Crosman pellet gun, model 357. Vande Hei has four and a half years of law enforcement experience, according to officials.
